What happens if my employer pays me less than the wage declared on my work permit application?

Discovery of either of the following triggers automatic cancellation of the work permit under Implementation Regulation 6735 Article 56(1)(n):

  • Actual wage below the declared wage on the work permit application.
  • Full-time contract changed to part-time after the permit was issued.

Additionally, if SGK obligations are only partially fulfilled (outside the exceptions in Article 60(3)), cancellation triggers too.

Watch-outs
  • The rule protects both wage transparency and the wage criterion in work-16. Employers can't promise X TL for the application and then pay less.
  • If your employer asks to pay you below the declared amount, the risk is yours. Your permit is what gets cancelled; their fine is smaller than your status loss.
  • Under-declaring wages to SGK is a separate SGK offence. The two violations stack — same employer behaviour, two compliance failures.
